My mother in law took out a payday loan through Ace and has not repaid it. As of right now it is in their cheapest cialis prices collections department, but I want to know if it will just stay a collections issue or does she have to worry about a warrant for a hot check.

Ok here is the correct answer….they can’t take out a warrant for a bad check on your mother in law. This is considered a loan and there are no debtors prisons. If you read the article posted above by extremenerd you will see that was just a letter sent out by the collection agency as a scare tactic…it says Warrant Intended..and was not an official police warrant. Trust me because i worked for a PDL (ashamed to admit) They can’t do anything and if they do start to threaten criminal action let them know that you will contact the FTC and report them for illegal collection activities- believe me that will stop them. Just make payment arrangements and pay when you can. Tell your mother in law don’t worry the police will not come to her door. Good luck.

Unless the check is a forgery – I see no reason for the check to be “hot”. Your M-i-L must be pro active in this case, and call Ace and make arrangements to start a repayment plan. If your MIL wrote a check from her own checking account to use for the payday loan – then she will be charged check overdrawn fees and the bank she wrote the check on will be sending her overdraft notices and closing her account. The D.A. only gets involved when there is a certain number of checks outstanding establishing a pattern of check writing for goods and services not necessary – i.e – purses, clothing, shoes, cosmetics, novelties, liqueur, etc.
Actually, from what I know, they have no legal standing..it’s illegal for them to take checks from consumers b/c they are post-dated..am I correct about the post-dated portion? b/c if it was…you can ask her…then no, they can’t send it anywhere but to a collection agency…**tell her to stay away from those, you’re being ripped off of a large amount your money you probably don’t have!!**
They will not send it to the DA.
